Nichia wins LED patent infringement lawsuit against HTC Nippon and its distributor

On 24 March, in a patent infringement lawsuit that Nichia Corp of Tokushima, Japan filed against HTC Nippon Corp (a Japanese affiliate of Taiwanese firm HTC Corp), and Kanematsu Communications Ltd (a distributor of HTC Nippon Corp), Tokyo District Court rendered a judgment, holding that the defendants have infringed Nichia’s patents.

In its judgment, the court found that the HTC Desire 626 smartphone distributed by defendants was equipped with white LEDs that infringe Nichia’s patents JP5177317 and JP5610056, and ordered the defendants to compensate Nichia for damages. The defendants did not appeal, and the judgment has become final and binding.

Nichia says that it seeks to protect its patents and other intellectual property rights and takes actions against alleged infringers in any country where appropriate and necessary.
